These Terms of Service ("Terms") govern your access to and use of TrackMotor's GPS tracking hardware and mobile/web applications (the "Service"), operated by [Company Legal Name]. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
TrackMotor provides a GPS tracking device paired with a mobile and web application that offers real-time vehicle location, trip history, maintenance reminders, geofence alerts, and manual expense tracking. Features and availability may change as the Service evolves.
You must create an account, authenticated through our identity provider, Clerk, to use the Service. You are responsible for keeping your login credentials secure and for all activity under your account. Self-registered accounts automatically create a personal organization; accounts added to an existing business organization are provisioned by that organization's administrator.
Access to the Service requires an active paid subscription; your tracking device will not transmit or display data without one. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. Business (fleet) subscriptions are billed per connected vehicle. You may cancel at any time; cancellation takes effect at the end of the current billing period, and we do not provide prorated refunds except where required by law.
Your GPS tracking device is licensed for use with the Service and must remain associated with an active subscription to function. Ownership of the physical device does not entitle you to use it with the Service without a corresponding subscription.
If you create or administer an organization (fleet) account, you are responsible for ensuring that adding a vehicle or driver to your organization, and any related location tracking, complies with applicable law, including notifying drivers that their vehicle's location is monitored. You must not use the Service to covertly track a vehicle or person without the legal right and, where required, their knowledge and consent.
You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service or another user's account or data; interfere with or disrupt the Service's operation; or reverse-engineer the tracking device or application beyond what is permitted by law.
Location and odometer data are derived from GPS signals and are estimates, not guaranteed measurements — actual values may vary due to signal loss, terrain, or device conditions. The Service is not an anti-theft, emergency, or security system and must not be relied upon as one; do not use it as a substitute for appropriate insurance, security devices, or emergency services.
The Service, including its software, design, and trademarks, is owned by [Company Legal Name] or its licensors. We grant you a limited, non-transferable license to use the Service for its intended purpose; you may not copy, modify, or redistribute it except as permitted by these Terms.
We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or misuse the Service. You may stop using the Service and close your account at any time; certain provisions of these Terms (such as limitation of liability) survive termination.
